It is natural that many former partners enter into new relationships after a shorter or longer period of being single. This circumstance alone does not affect maintenance payments. The situation changes, however, if one of the ex-partners cohabits with the new partner. In that case the calculations regarding maintenance obligation or entitlement change, because from that point courts generally assume that the new household can provide for itself and is no longer, or is significantly less, dependent on maintenance payments – consequently the new partnership is often concealed.
Some people may simply be forgetful and fail to think of their duty to report changes. Far more often, however, the person intentionally conceals changed circumstances to avoid reductions. The inventiveness displayed is enormous: no additional name on the doorbell or letterbox, the new partner’s car parked some distance away, entering or leaving the house only when unobserved, and so on.
However, whether deliberate or unintentional, concealing changes in income and living circumstances is an offence, as is failing to provide maintenance or failing to provide it in full (§ 170 StGB — breach of maintenance obligation). Equally, a person asserting a maintenance claim who makes false statements may forfeit their entitlement (§§ 1579 and 1580 BGB).
